Ad-interim Order The plaintiff by challenging the impugned notice u/s 314 of MMC Act seeking injunction to restrain the defendant from taking action upon the impugned notice. The learned advocate for the plaintiff submitted that the plaintiff is owner and in possession of the suit structure which is in existence prior to datum line. They relying on certain documents i.e. Assessment Bill, Shop and Establishment Certificate, Telephone Bills, Electricity Bills, etc which shows the existence of suit structure.  The plaintiff has apprehension regarding the demolition of suit premises at the hands of defendant.  Hence, requested for granting protection to the suit structure. Per contra, the learned advocate Basutkar for MCGM and the officer of the MCGM stated that the notice structure is unauthorised and same is coming on the public road.  Hence, requested for refusing the ad-interim injunction. On perusal of impugned notice dated 30/07/2019,  it appears that the occupier has committed the encroachment upon the MCGM road without permission of the competent authority.  As per the contention of the defendant the notice structure is unauthorised.  But the said fact is denied by the plaintiff by contending that the notice structure is in existence prior to the datum line.  Therefore, the core question before the court is the validity of impugned notice and authenticity of the notice structure.  At this stage, considering the urgency and apprehension of plaintiff regarding demolition of notice structure it would be proper to direct the defendant not to take any coercive action against the notice structure till next date.
