have taken out the Notice of motion for condonation of delay of 35 days in filing written statement and
to take the written statement of defendants on record. According to defendants the delay in filing
written statement is not intentional and deliberate. If delay is not condoned then irreparable loss would
be caused to the defendants. Plaintiff filed reply to Notice of motion on itself and submitted that
necessary order may be passed. Perused the Notice of motion and reply. Heard both sides. Considering
the reason mentioned in the Notice of motion, it appears that reason for condonation for delay is not
intentional. Hence, it is necessary to condoned the delay and to take the written statement of defendants
on record. Hence, I pass following order ORDER 1. Notice of Motion No. 1729/2025 stands allowed.
2. Delay in filing written statement is hereby condoned and written statement of defendants be taken on
record and exhibited. 3. Accodingly Notice of motion NO. 1729/2025 stands disposed off. Exh. 7
Written statement of defendants. Adjourned for framing issues to 11-12-2025.
