Order on chamber summons no. 105/18 This chamber summons is taken out by the plaintiff\''s to implead the landlord as party defendant in the suit and also want to correct the name of plaintiff\''s and defendant\''s in the title clause.  The learned advocate for the plaintiff\''s submitted the landlord is residing on the second floor of the suit building, he is necessary party who\''s presence is required to adjudicate the matter.  Further it is submitted that there is typographical mistake in the name of plaintiff\''s and defendant\''s in the cause title. Therefore they want to carry out the amendment in the plaint and want to implead the landlord in the suit.  The said chamber summons is opposed by the MCGM.  The proposed amendment sought by the plaintiff\''s is relating to the subject matter of the suit and does not change the nature of the suit.  Therefore, it would be proper to allow the chamber summons.  Hence, following order - Order -
1.  Chamber summons no. 105/18 is allowed.
2.  Plaintiffs are permitted to implead the proposed defendant in the plaint and
     to carry out the necessary amendment in the plaint and notice of motion as
     per schedule annexed with chamber summons within stipulated period.
3.  Plaintiff to supply the copy of amended plaint and also served to the other
     side.
4.  Chamber summons no. 105/18 is hereby disposed off.

The learned advocate for plaintiff submitted that the occupier of the first and second floor of the suit building vacated the premises.  Therefore, they have no objection to demolish the first and second floor.  Further they submitted that there are two conflict structural audits report and requested for referring the matter for TAC. But the learned advocate Sardar for MCGM opposed the referring the matter for TAC by contending that there is no conflict report to refer the matter to TAC.  They submitted that the structural audit reports carried by the plaintiff was inadequate and there was some short falls.  Therefore, matter is not liable to refer the TAC.  Considering the submission of both sides it is required to hear the notice of motion and decide it on merit.  Hence, adjd for notice of motion hearing on 30/08/2019.
