Both the sides are heard. The learned advocate for the plaintiff has completed his argument at 5.00 p.m.  It is contended that in view of section 47 of Slums Act 1971, the corporation has no authority to issue notice of demolition when suit property is in slum area.  On the contrary, the ld adv Shri Rathod for the defendant relying upon the Honble Authority Raghuvir Madhyamik Vidyala and Anr Vs Municipal Corporation of Greater Mumbai in Writ Petition No.2952 of 2012, argued that corporation is only competent authority to initiate action against illegal construction and encroachments.
It reaveals that three notices for three structures are issued to these plaintiffs under section 351 of MMC Act.  According to the ld advocate the structures are old and tolerated however according to the corporation they are an unathorised and illegal structures.  Both the parties have advanced arguments at the length however from tomorrow onwards there are Diwali Holidays therefore the notice of motion can not be disposed of by decision on merits today itself moreover there was interim protection to the structure of the plaintiffs since the year 2019, considering this fact following order is passed -
The defendant is directed not to take coercive action till next date against the notice structure in view of notices issued to the plaintiffs under section 351 of MMC Act.
