According to defendant no. 1, defendant no. 1 was at his native place when copy of plaint was served. Due to personal work he was travelling. Already in N/m no. 3996/2024 ex-parte order set aside. There is delay for filing the written statement therefore defendant no. 1 has taken out present N/m. Considering the grounds mentioned in the N/m I think one opportunity be given to the defendant no. 1 to contest the suit on merit. Hence, I proceed to pass the following order. 1. N/m no. 1498/2025 is allowed in terms of prayer clause A and B subject to cost of Rs. 1000/- payable by the defendant no. 1 to plaintiff. 2. On payment of cost written statement defendant no. 1 be taken on record. 3. N/m no.1498/2025 is hereby disposed of. Matter is adjourned to 07.10.2025 for compliance.
