From record it appears that suit was proceeded without w/st as written statement not file by deft no.1 and 2. By way of this N/m deft&amp#039s seeks relief to condone the delay of 11 months and their w/st be taken on record. On the other hand adv for plff opposed the same by rasing objection that there is no sufficient reason is given for alleged delay. On perusal of record it appears that present suit is filed for declaration and injunction therefore, to decide the issues or real controvery between the parties of the suit, it would be proper to take w/st of deft no.1 and 2 on record, by condoning the delay subject to cost. As to give fair opportunity delay is condoned on cost of Rs.2000/- each and after payment of cost to the plff, w/st of deft no.1 and 2 be taken on record and exhibited. Adv for deft no.1 and 2 directed to comply the aforesaid order on or before next date, on failure aforesaid order will be vacated automatically. Accordingly, N/m no.213/19 is disposed of.
