Considering the material placed before me, nature of offence registered against the accused is under Section 302 of I.P.C. with Pantnagar Police Station having C.R.No.103/2019. The objection raised by the A.P.P that application is not maintainable having some substance, in view of the directions of Hon. High Power Committee of Hon. Bombay High Court and Corrigendum dt.18.05.2020 to minutes of High Power Committee dt.11.05.2020. The offence registered against the accused does not fall under the category to give benefit of COVID-19 to the accused to consider for his release on his personal bond and/or even on certain conditions.
The latest judgment of The Hon.Bombay High Court in LD VC Bail Application No.49 of 2020 delivered by The Hon.Justice Smt.Sadhna Jadhav on 15.05.2020 while considering the bail application moved by the accused observed that the Court concluded that in view of the guidelines of High Power Committee it would be necessary to take into consideration merits of the matter, the gravity of the offence and the attitude of the accused indulging into criminal activities despite preventive measures. The applicant does not deserve temporary bail.
Therefore, the offence registered against the accused being grievous in nature and does not fall into the category as laid down above and even on merit application for bail cannot be considered to release the applicant/accused on bail, as prayed. Hence, application is not maintainable, therefore, the application is liable to be rejected. Hence, I pass the following order
ORDER
1. Application moved by the applicant/accused Prakash Vishwanath Sing in Sessions Case No.06/2020 (C.R.No.103/2019) from jail for bail stands rejected.
2. Inform the applicant/accused through Superintendent of concerned Jail.
3. Accordingly application be disposed of.
