Perusal shows the relevant dates, as follows
On 19.01.2019, Suit came to be filed.
Initially, the plaintiff had preferred Interim Application (Notice of Motion No. 100737 / 2019) for interim reliefs.
On 30.01.2019, defendant No. 2 is served (Exh.7).
Defendant appeared in the Suit and application for interim relief was contested.
On 12.07.2019, Interim Application i.e. Notice of Motion No. 100737 / 2019, was allowed by my Learned Predecessor. In Clause No. 3 of the Operative Part, specific directions were given to both defendants, as follows 3. Defendant may submit written statement in detail to expedite hearing.
In backdrop of said Order, defendants were expected to file their Written Statement within 120 days i.e. by 09.11.2019.
Judicial Notice is taken that, there was Nationwide Lockdown from 15.03.2020 to 28.02.2022, and said period is excluded from computation of limitation.
It was on 14.07.2022, that defendant No. 2 filed Notice of Motion No. 102496 / 2022, seeking condonation of delay of 75 days in filing Written Statement.
Notice of Motion is under strong objection of plaintiff.
The amended First Schedule / Order 5 Rule 1 (1) of the Code of Civil Procedure provides that, defendant is required to file Written Statement within 30 days. In case he fails to file Written Statement, then for reasons to be recorded in writing and on payment of such cost as deems fit, the Court may allow him to file Written Statement, but within 120 days from date of service.
