ORAL ORDER
1) Plaintiffs have taken out present chamber summons for
allowing them to amend the plaint as per Schedule for bringing on
record the heirs and legal representatives of deceased plaintiff No.1.
2) Perused the chamber summons, affidavit in support of
chamber summons and documents filed therewith. Heard Ld Advocate
for plaintiffs. As the defendants and their Advocates are absent they
could not be heard.
3) From the affidavit in support of chamber summons and
the copy of death certificate it appears that plaintiff No.1 expired on
20/8/19. From the affidavit in support of chamber summons it

appears that right to sue, survive in favour of proposed plaintiffs. The
plaintiffs have taken out present chamber summons on 19/11/19. As
such it appears that plaintiffs have taken out present chamber
summons within prescribed period and proposed plaintiffs are heirs
and legal representatives of deceased plaintiff No.1.
4) Considering the matter on record and above discussion
chamber summons deserves to be made absolute. Therefore, court
proceeds to pass the following order:
ORDER
1) Chamber Summons No. 2345 of 2019 is made absolute.
2) Plaintiffs shall carry out the amendment as per schedule within 14
days from the date of this order.
3) Chamber Summons No. 2345 of 2019 is disposed off accordingly
