ORDER
Plaintiff has taken out Chamber Summons on the ground that
pursunant to the fresh certificate of incorporation consequent upon
change of name issued by the Registrar of Company, Mumbai on
December 7th 2018 whereby name of the defendant no.1 has been
changed from INTIME EQUITIES LIMITED to ITI SECURITIES,
BROKING LIMITED. It is further prayed that plaintiff be allowed
to amend the plaint and proceeding in Suit No.7594 of 2003 as per
schedule I.

Defendant filed written say and submitted that Chamber
Summons be allowed as prayed for.
Heard Ld.Counsel for plaintiff and defendant. Perused
document tendered by plaintiff in support of. Plaintiff wants to
change the name of defendant as per the certificate of
incorporation. In view of facts and circumstances, I found that the
proposed amendment is formal in nature and if permission be
granted to the plaintiff to incorporate change name then no
prejudice would be caused to the case of defendant. Defendant
already registered no objection to grant Chamber Summons.
Hence, I proceed to pass following order.
ORDER
1. Chamber Summons No.2312 of 2019 is made absolute in
terms of prayer clause(a) and (b).
2. Plaintiff is permitted to carry out amendment in terms of
schedule within 14 days.
