Read the Notice of Motion no.3996/18 and say given by the advocate for plaintiff. Heard. It appears that there is 60days delay in filing the vakalatnama by the advocate for defendant, from the date of service of writ of summons. The plaintiff has given the say to allow the Notice of Motion subject to heavy cost, without going in to the details,  it appears that the delay cause is not intentional and malafide. Hence it is just and desirable to allow the Notice of Motion. In the result, Notice of Motion no.3996/18 is allowed subject to cost of Rs.2500/- payable by the defendant to the plaintiff, on or before the next date, without fail.
