JUDGMENT
1. This is petition to appoint petitioner as a guardian of a person
and property of mentally ill person namely Vikram Singh Kuldeep Singh
Ghuman, under section 14(1) of the Right of Person with Disabilities
Act, 2016.
2. The facts in brief are as under;
Petitioner is the sister and natural guardian of Vikram Singh
Kuldeep Singh Ghuman. Viram Singh is mentally retarded person and
at present, he is in custody of Medical Officer, Regional Mental

Hospital, Thane. The petitioner and Vikram Singh's father Kuldeep
Singh died on 8/10/2017 and their mother Amrit Kaur died on
30/8/2018 at Mumbai. Petitioner is the lone sister of Vikram Singh and
she is taking care of him. Some amount is lying in the name of Vikram
Singh in Punjab National Bank and Union Bank and some Mutual Funds
as specified in Exh. 'G'. Vikram Singh is unable to take decision.
Hence, prayed to appoint her as a guardian.
3. Public notice and citation notice were issued. However, no one
raised objection. Heard Mr. K.C. Sanil Advocate for petitioner.
4. I have perused the record. It appears that petitioner and Vikram
Singh are sister and brother inter say. Their father Mr. Kuldeep Singh
died on 8/10/2017 and their mother Amrit Kaur died on 30/8/2018.
The medical papers do show that said Vikram Singh is suffering from
mental disease and he can not take any decision. At present, Vikram
Singh is in custody of Medical Officer, Regional Mental Hospital, Thane.
However, petitioner is taking care of Vikram Singh. Hence, being his
sister, petitioner is a fit person to be appointed as a guardian of Vikram
Singh. Therefore, following order.
ORDER
1. The petitioner Manmeet Kaur Kuldeep Singh Ghuman, is
appointed under section 14(1) of the Rights of Persons
with Disabilities Act, 2016 as the total support guardian
for Vikram Singh Kuldeep Singh Ghuman and as Manager
of his Estate as mentioned in Exhibit 'G' of the petition.

2. The petitioner shall file in this Court in a period of three
months from today and three months immediately after the
end of every financial year, the returns of the movable and
immovable properties and dues owned by Vikram Singh
Kuldeep Singh Ghuman.
3. The petitioners shall take prior permission of this Court
before transferring any of the movable and immovable
properties of Vikram Singh Kuldeep Singh Ghuman.
4. The petition is allowed and disposed off accordingly.
