ORAL ORDER
1) The chamber summons is filed by the plaintiff to
serve the defendant through substitute service by paper
publication in two newspapers at the locality in which the
defendants are last know to have actually and voluntarily resided,
carried on business or personally worked for gain. The Chamber
summons is supported by affidavit of Bajrangi Shivprasad Yadav
who on oath stated that the writ of summons of defendant has
returned unserved. The defendant No. 1 and 2 were served by
way of pasting. The defendants did not appear. The report of
bailiff does not mention anything about presence of defendant
No. 1 and 2. Hence prayed to serve the Chamber summons
through paper publication.

2) I have gone through the record. The defendant did
not filed appearance till date. The defendant could not be said to
be served as per bailiff report. Hence the application needs to be
allowed and pass following order :
ORDER
1. The Chamber summons is made
absolute in terms of prayer (a).
2. Accordingly, chamber summons is
disposed of.
3. Chamber summons be registered for
statistical purpose.
