By Notice of Motion No. 2729 of 2016 and NM No. 1810 of 2017 defendant no. 4 prayed for detaining the plaintiff in civil prison for disobdience of the order of this court. It is, clear that in view of suit reliefs, this Contempt NMs can not be tried together with the suit in view of the ratio laid in Rampyaribai Sukhdeo Daga V. Niladevo Narayandas Jakhotiya, 2007 (4) Mh.L.J. 213. Surely, if it would require conduction of the inquiry, wherein the plaintiff may also choose to lead the evidence in support of his contentions. However, it would not be appropriate to try and decide these Contempt NM along-with this suit, as they may hamper its very progress. Therefore, without recording my finding on its merits, the Contempt Notice of Motion No. 2729 of 2016 and NM No. 1810 of 2017 are disposed of as not triable, along-with the suit. The plaintiff is still placed at liberty to prefer separate Miscellaneous Judicial Case about the said Contempt, if he desires. Hence Notice of Motion No. 2729 of 2016 and NM No. 1810 of 2017 are disposed of accordingly. Parties to take note.
