Despite service of Chamber Summons by way of publication of Chamber Summons in local newspaper, LR’s of defendant nos.06, 11 and 22 failed to appear and oppose the Chamber Summons. CS no.38/2022 is taken for bringing LR’s of defendant no.06 who died on 01.01.2020 and defendant no.22 who died on 07.07.2021. In view of relaxation of limitation by Hon’ble Supreme Court in SMW(c) No.3/2020, there is no delay in taking out Chamber Summons to bring LR’s on record. CS no.880/2022 is taken for bringing LR’s of defendant no.11 on record who expired on 24.12.2021. Chamber Summons is filed on 22.06.2022. There is delay of 144 days in bringing LR’s on record. Said delay is explained in the affidavit in support. Suit is filed for partition. Therefore right to sue survives against proposed LR’s. Hence, both the Chamber Summons deserves to be allowed. Accordingly I passed following order.
Order:
1) Chamber Summons no.38/2022 and Chamber Summons No.880/2022 are allowed in terms of prayer clause (a) to (c).
2) Plaintiff is permitted to carry out amendment as per Schedule annexed to both Chamber Summons within limitation.
