ORDER
Perused the Notice of Motion as well as the entire record with due care. The learned Advocate for the plaintiff sought further time to take steps against defendant no. 14. However, on  perusal of the record, it is evident that the Notice of Motion has been pending for more than 5 years. It further appears that on 10.12.2025, the matter was adjourned by granting a  opportunity to the plaintiff.
Despite such opportunity having been granted, the learned Advocate for the plaintiff has once again sought an adjournment without assigning any justifiable or sufficient cause. The conduct of the plaintiff clearly indicates a lack of diligence and an unwillingness to prosecute the present Notice of Motions. This Court cannot permit repeated adjournments to prolong the proceedings, particularly when the application has remained pending for a considerable length of time.
In these circumstances, no useful purpose would be served by keeping the present Notice of Motions pending. Accordingly, Notice of Motion No. 522/2021, 4909/2019 and 1837/2020 is tagged alongwith the main suit and stands disposed of accordingly.

ORDER
In view of the order dated 25.03.2026, Notice of Motion Nos. 522 of 2021, 4909 of 2019 and 1837 of 2020 came to be dismissed for want of prosecution, as on the said date none appeared on behalf of the plaintiff when the matters were called out and no steps were taken to prosecute the same.
However, today, the learned Advocate for the plaintiff appeared before this Court and submitted that the absence on the earlier date was neither intentional nor deliberate, and that the plaintiff has approached this Court at the earliest opportunity seeking restoration of the above Notices of Motion. It is further submitted that in the present matter there are in all 14 defendants, out of whom Defendant No.14 has expired, and that an ad-interim injunction is operating in favour of the plaintiff. It is also pointed out that for a considerable period none has appeared on behalf of the defendants.
A perusal of the record indicates that there has been no representation on behalf of the defendants for a long time. It further appears that the dismissal of the Notices of Motion was not on merits but solely on account of non-appearance of the plaintiff on the relevant date. Considering that the plaintiff has promptly approached this Court seeking restoration, and in view of the subsisting ad-interim relief, refusal to restore the matters would result in serious prejudice to the plaintiff.
In these circumstances, and in order to advance substantial justice and afford an opportunity for adjudication on merits, this Court is inclined to take a lenient view.
Hence, Notice of Motion Nos. 522 of 2021, 4909 of 2019 and 1837 of 2020 are restored to their original stage, subject to the plaintiff taking necessary steps in respect of deceased Defendant No.14, in accordance with law.
The plaintiff shall take diligent steps to serve all the defendants and ensure that the matters are proceeded with expeditiously. No further unnecessary adjournment shall be granted.
Earlier order, if any to be continued till next date.
