Adv. Vimi Mehta for Plaintiff is present. None for defendant By this Ch/S plaintiff has
prayed for permission of amendment in the plaint by adding the Municipal
Corporation of Greater Mumbai (MCGM) as necessary or proper party as defendant
no. 2 and additional facts and grounds as per schedule II for effective adjudication of
the suit. In support of Ch/S, and affidavit is filed by the plaintiff wherein it is averred
that the MCGM being sovereign authority, powers are available to record Births and
Deaths of the citizens. Accordingly it is prayed that Ch/S be made absolute in terms of
prayer clause (A). To this Ch/S no objection is raised on behalf of defendant. Heard
both sides perused record. For the proper and effective adjudication of the suit, it
appears that MCGM is necessary party. Therefore Ch/S is made absolute in terms of
prayer clause A. plaintiff is directed make necessary amendment as per the schedule
and serve the copy of plaint and relevant documents to newly added defendant no. 2.
