This is a notice of motion for setting aside ex-parte decree vide Order 9 Rule 13 of the C.P.C. 1908 and to permit the applicant to intervene as party defendant.
The applicant has been heard on the point of maintainability. Order 9 Rule 13 of the C.P.C. 1908 contemplates the defendant as an applicant, who is entitled to apply before the Court for setting aside of the ex-parte decree. The applicant is not party to the suit. Hence, he is not entitled to apply under Order 9 Rule 13 of the C.P.C. 1908. The notice of motion is misconceived. Hence the order-

This notice of motion has been taken out for stay to the execution of decree vide Order 21 Rule 29 of the Code of Civil procedure 1908 by the applicant on the ground that one suit 3321/2007 filed by plaintiff against the applicant is pending.
Rule 29 of Order 21 of C.P.C, 1908 contemplates the contingency where the suit against the decreeholder is pending in another Court. However, the suit 3321/2007 is the suit filed by the decreeholder and not against decreeholder so that there is no question of applicability of Rule 29 of Order 21, of C.P.C. 1908 for staying the execution of decree. The notice of motion is beyond the perview of Order 21 Rule 29 of the C.P.C. 1908 and the same is liable to be dismissed.
