The general principal for jurisdiction of civil Court emerge as follows -
1.  The civil Court jurisdiction to try all suit of a civil nature unless there a cognizance barred either expressly or emplidly.
2.  Jurisdiction of a court dependents upon the awarement made in plaint and not upon the defense in a written statement.
3.  A statued ousting jurisdiction of a court must be strictly construed all this three points for deciding jurisdiction are material for body of the plaint no were transpires any prayer of against the MCGM/corporation. The plaints transpires family dispute between members of a joint family this court is specially established to run matter pertaining to the MCGM corporation and not for other civil rights. Therefore, considering the pleading of a plaint it seems that this court is oust from the jurisdiction. Accordingly, I passed the order-

Therefore, presence of deft. no. 1/MCGM to decide controversy between the parties in this set of facts is not necessary. Hence, name of deft. no. 8/MCGM be deleted from the plaint. Consequently, the suit remains between private parties and therefore, Registrar, City Civil Court, Mumbai to assign the matter to the court dealing with private Civil Suits for disposal in accordance with Law.
