The Ld. Advocate on behalf of the plaintiff has submitted that the defendant corporation without considering the reply filed by the plaintiff passed speaking order dated 04.12.2019 and requested to give direction to the defendant corporation to pass speaking order after considering the reply filed by the plaintiff dated 30.11.2019 received by the corporation on 11.12.2019. The Ld. Advocate Mr. Sutar for defendant corporation has submitted that the defendant corporation has passed speaking order with following due process of law. The officer of the defendant corporation is ready to consider reply filed by the plaintiff if this Hon\''ble Court give direction to the defendant corporation.
In view of submission of both the parties I think it is proper to direct to the defendant corporation. It is hereby directed to the defendant corporation to pass the speaking order freshly after considering reply filed by the plaintiff dated 30.11.2019. Till one week after passing the speaking order freshly the defendant corporation shall not take any action against the plaintiff in respect of the suit premises in pursuant of notice issued by the defendant corporation u/s. 351 of MMC Act dated 05.11.2019. Hence, this suit is hereby disposed off. Draft NM is also disposed off accordingly. NM be registered for statistical purpose.
