Exh.15-Affidavit of service of chamber summons No.101536 / 2024.
Perusal shows that through Chamber Summons No.101536 / 2024, the plaintiff
has prayed for addition of Jayesh Dedhia as defendant No.2. According to
plaintiff, proposed defendant No.2 Jayesh is partner of defendant No.1
Neminath Developers. As plaintiff got delayed information about the partner,
they preferred the present chamber summons at this belated stage.
Plaintiff also filed affidavit of service on 03.12.2024, stating that the proposed
defendant is served regarding the chamber summons.
Roznama shows that defendant is continuously absent.
As the chamber summons is unchallenged and considering its technical nature,
it is disposed off, by following order -
ORDER
1. Chamber Summons No. 101536 / 2024, is allowed.
2. By next date, plaintiff shall carry out necessary amendment, shall
file copy of amended plaint and shall supply copy of amended Plaint
to defendants.
3. If plaintiff fails to comply the Order by next date, then the Suit shall
proceed further.
4. Order pronounced in Open Court.
5. Record of Chamber Summons No. 101536 / 2024 shall be part of
Summary Suit No. 100016 / 2022.
Suit is adjourn to 22.04.2025 for Compliance.
