The perusal of the application Exh. 05 leaves no doubt to conclude that the plaintiff desires to withdraw the suit in view of Order XXIII Rule 1 CPC, 1908, unconditionally. The plaintiff is present. He submitted that he does not wish to proceed with the suit. In the result, the suit is disposed off as withdrawn unconditionally. Consequently, all the pending applications and NM 4778/19 are filed and disposed off respectively. In the circumstances, the parties to bear their own costs of the suit. Bill of cost be drawn-up accordingly.
