Heard Plaintiff\''s advocate about ad-interim relief claimed in Notice of Motion no.661/2020. Plaintiff\''s advocate pointed out para no.3 of the plaint and argued that Plaintiffs came to know about alleged sale deed dated 04/03/2014 when the charge-sheet was filed by police in the month of December 2016. This suit is lodged on 10/12/2019. It is pertinent to note here that Plaintiffs have not given even specific date of the knowledge of the alleged sale deed and this suit is also filed at the flag end of 3 years period from December 2016. It was expected that Plaintiffs should have given the exact date of knowledge of alleged sale deed so that court would have been in a position to calculate the exact period of limitation. Any how, after lodging this suit on 10/12/2019, copies of Notice of Motion were not served upon Defendants till 11/03/2020. Plaintiffs advocate submitted that in between 10/12/2020 to 11/03/2020, copies of Notice of Motion and plaint could not be served upon Defendants because Defendants are changing their address from time to time. Hence, according to Plaintiffs advocate, considering the fact that Plaintiffs parents were owners of suit flat, it is necessary to grant ad-interim relief as prayed in the Notice of Motion, because Plaintiffs have apprehension that Defendants have learnt in the month of March 2020 that Defendants are going to create third party interest in suit premises.
Defendants advocate pointed out that alleged sale deed was executed on 04/03/2014. Plaintiffs have pleaded that Plaintiffs have got knowledge of said sale deed in the month of December 2016 and this suit is lodged on 10/12/2019. As Plaintiffs themselves have not taken care for 3 months for serving the copies of Notice of Motion and Plaints, I find that there is no urgency in the matter and even if the fair chance will be given to Defendants to file their reply to NM, no harm will be caused to Plaintiffs because already for 3 months after lodging the suit, Plaintiffs have not pressed for ad-interim relief, hence case is adjourned to 02/04/2020 for NM reply.
