granted to deft no.2 to defend the suit by filing
written statement. So for as previous concerned the
paragraphs no 4 to 7 of the affidavit in support has
satisfactorily explained the reasons for not filing WS
within statutory period . Hence in the interest of
justice, I pass the following order. NM no. 4752/19
is allowed and made absolute in terms of prayer
clause (a) and (b) with an direction that deft no.2
to file written statement today only on record. NM
no. 4752/19 disposed off accordingly. Deft no.2 has
filed WS t.o.r. and marked Exh.6. Heard partly of
advocate for deft no.2 in NM no. 252/20 Keep the
matter for hearing on NM 252/20 and NM 1434/19.
