Perused Ch/s which is supported by an affidavit.  The defendant has given no objection.  It is an admitted fact that as per order dated 15.05.2008 passed by the Hon\''ble High court in N/m No.1816/2008, the suit property was handed over for redevelopment purpose and now the new building is constructed and reserved flat is Flat no.601 on 6th floor of new building.  Considering the fact that now this new premises is the subject matter, the proposed amendment is necessary for deciding real question of controversy between the parties.  Hence as per provision of Order 6, Rule 17 of the C.P.C., I pass the following order.ORDER
1 Chamber summons No.1857/2018 is allowed and made absolute in terms of prayer clause (a) and (b).
2 The plaintiff to carry out the amendment within one week and shall supply the copy of amended plaint upon the defendants within one week thereafter.
3 Chamber summons is disposed of accordingly.
