ORDER
This is a chamber summons taken out by plaintiff for
incorporation of speaking order in plaint.
2. Heard ld. advocate Pratap Singh for plaintiff at sufficient
length.
3. Ld. advocate Mhatre for MCGM submits that on perusal of
photographs, there is vertical extension of suit premises upto 3rd floor.
It indicate from the speaking order that total construction is illegal. She
has objected for continuation of E.O.C. However speaking order can be

read over, it is prayed for arguments on notice of motion.
4. It is assured by ld. advocate Pratap Singh for plaintiff that
he will file replycumrejoinder on various photographs and position
brought by the MCGM positively on 17/12/2019 and argue on notice of
motion also.
5. Considering speaking order is issued later on, chamber
summons needs to be allowed. Hence following order is passed :
ORDER
1. Chamber Summons No. 2235/2019 is allowed.
2. Plaintiff to carry out amendment in two days.
3. Plaintiff to ready for argument alongwith rejoinder
positively on 17/12/2019. In default to argue on
17/12/2019, EOC will stand vacated without reference to
the court.
4. Ch/s No. 2235/19 is disposed off accordingly.
