The officer of Defendant/MCGM has made oral statement that they have not marked the area with yellow line and they are not in need of 12.59 sq.meter area for road widening purpose as alleged by the plaintiff in paragraph no. 14 of the plaint. Ld. adv. for the Defendant has pointed out from the plaint paragraph no. 13 that the plaintiff himself has demolished affected area of 14.49 sq. meter for road widening. In view of above statements by Defendant/MCGM, nothing  survives of notice of motion. Hence, it is disposed off. NM be registered for statistical purpose. Suit to proceed further.
