ORAL ORDER
Plaintiff has moved present notice of motion for restoration of
suit to its original stage.
2. The defendants nos.1 to 3 are duly served with notice of motion
but they failed to appear. It is stated that plaintiff was unable to appear
before the Court, hence could not lead evidence. It is further stated that
the advocate for plaintiff was also not keeping her health well,
therefore, could not attend the Court. The suit of plaintiff is for decree
of possession. Considering the nature of suit and relief sought by the

plaintiff it is just and necessary to give one more chance to lead
evidence to plaintiff. Hence, following order passed by to meet both
ends of justice.
ORDER
1. Notice of Motion No. 4604/2019 is hereby allowed.
2. Civil Suit No. 2594/2013 is restored to its original stage, subject
to costs of Rs.6,000/- to be paid to defendants within a period of 15
days from today.
