Narayan for defendant is present. Order below CH/S No. 2177/19 Perused the chamber summons which is supported by an affidavit of defendant. As per record since long nobody is appearing for the plaintiff. On 02.08.2021, specific directions were given to plaintiff for file reply and then it was adjourned to 24.09.2021. Till today the plaintiff has not filed the reply. Hence, I am considering this chamber summons without reply of plaintiff. Heard Ld.Adv. Narayan for defendant. In para no.3 of the affidavit in support the details of the documents are mentioned, the copies of which are not furnished to defendant. Perused the plaint on record. It is submitted that unless the defendant goes through various documents/ letters as mentioned in the plaint the defendant will not be in position to file written statement. Considering the nature of dispute and if the plaintiff has pleaded about certain documents, it is necessary to allow this chamber summons to the extent of giving the defendant an opportunity of inspecting the documents which are mentioned in the plaint. Hence, in the interest of Justice I pass the following order ORDER Chamber Summons No. 2177/19 is allowed and made absolute in terms of prayer clause (a) and (b) and till the compliance of same, the time to file written statement is extended.
