ORDER
This is a chamber summons taken out by plaintiff to
incorporate the speaking order issued by the designated officer dated
09/10/2019.
2. Heard ld. Advocate Pratap Singh for plaintiff, requested to
allow amendment in Para No.13 and prayer clause as mentioned in
schedule.
3. Perused reply endorsed below chamber summons. Heard
ld. Advocate Mhatre for MCGM. It is strongly resisted.

4. It is not disputed that the speaking order came to be
pronounced during pendency of the suit.
5. Plaintiff has the right to agitate the findings given in the
speaking order. It is in continuation of the impugned notice issued by
the MCGM. Hence chamber summons deserves to be allowed. Hence
the order :

1. Chamber Summons No. 2178/2019 stands allowed.
2. Plaintiff to carry out the amendment, within a week
from uploading the order.
3. Ch/s No. 2178/19 is disposed off accordingly.
4. Plaintiff to submit photographs of the suit premises
alongwith unscaled map showing Height, Length and
Width of suit premises with four boundaries.
