ORAL ORDER
This matter was placed before the In-charge Court
yesterday on 20.08.2020. The plaintiff and the Power of Attorney
holder of the defendant Nos.1 and 3 filed Consent Terms that they have
amicably settled their dispute out of the Court and they have consented
to pass decree in terms of the consent terms. The copy of Power of
Attorney of the defendant Nos.1 and 3 and the Resolution passed by the
defendant No.1 were produced on record. The In-charge Court has
fixed the matter today for further order.
2 The plaintiff and his Power of Attorney holder both are out
of the country and this Consent Terms have been filed on their behalf by

their advocate confirming that the matter is settled out of the Court and
the suit be disposed of accordingly. The learned advocate for the
plaintiff submits that it is not possible for the plaintiff and his Power of
Attorney to come to India due to COVID-19 Pandemic. The plaintiff has
received the dues from the defendant No.1 and thus, the purpose of the
suit has been served. Therefore, the suit may be disposed of. Hence, the
following order.
O R D E R
1. The Consent Terms (Exh.9) are verified and taken on record.
2. The suit against the defendant No.2 and the defendant Nos.4 to 7
is disposed of, in view of Exhibit-8, as the claim against them is
abandoned by the plaintiffs.
3 In view of the Consent Terms (Exhibit-9), the suit is disposed of
as withdrawn uncondinally.
4 All the interim orders passed in the suit shall stands vacated.
5 In the circumstances, no order as to cost.
6. Suit is disposed of, as compromised.
