motion is taken out by defendants for framing additional issues. It is the
defence of defendants that performance of intimation letter dated
16.10.2007 has become impossible for want of permission from the
Competent Authority. Specific defence to that effect find place in the
written statement. Hence, additional issues is necessary. Re-casted issue
no.4 is not necessary. In this backdrop, notice of motion is partly

ORDER
1. Notice of Motion No. 4515 of 2019 is hereby partly allowed with
no order as to costs.
2. Re-casted issue no.4 is deleted and one additional issue is
