register. I have perused the contents of draft chamber
summons it is submitted by the plaintiff bank substitute
service writ of summons be permitted to him for
appearance for defendant no. 2 and 3. However, in view of
order dated 06.07.2013 suit is dismissed against def no. 2
and 3. and therefore there is no necessity to issue any kind
of publication of writ of summons against defendant no. 2
and 3. Hence, I proceeded to pass following order. Order 1)
Draft chamber summons is rejected. Present suit is pending
in the court since 2001 in view of order dated 06.07.2013
suit against defendant no. 2 and 3 is dismissed by the court.
Since 06.07.2013 to till today no step is taken by the
plaintiff against the order moreover failed to take steps to
secure appearance of defendant no.1 today also tender draft
chamber summons However, rejected by this court by
passing detail order suit is pending since 2001 and plaintiff
choose not to contest the suit by non taking steps inclined
me to pass following order. ORDER. 1) Suit is dismissed
with cost.
