1. The defendants have filed instant Notice of Motion praying
for condonation of 13 days delay in filing Written Statement.
2. The Notice of Motion is formally opposed by the plaintiff.
The reasons assigned by the defendants that the defendant no. 4
was not available to give instructions for preparing Written
Statement as he was out of Mumbai. In my view, the defendants
assigned sufficient reason to condone the delay. Thus, I proceed
to pass the following order :
