plaintiff is present.
Adv. Ms. Vidya Vyavhare for defendant/MCGM is present and
filed say on Exhibit 3 Taken on record. It is marked as

On last date application for withdrawal of suit was filed by
the plaintiff with liberty to file fresh suit. Say of defendant was
called on the said application. The defendant filed say to the said
application and objected for withdrawal of suit with liberty.
Now the Adv for plaintiff submitted that plaintiff want to
withdraw the suit unconditionally. Advocate for defendant has no
objection for withdrawal of suit unconditionally.
Application for withdrawal of suit bears signature of
Authorized representative Aadarsh Diwakar Pandey and also
bears Signature of adv for plaintiff. Copy of authority letter and
driving license is also attached to the withdrawal application.
As the plaintiff withdrawing the suit unconditionally, it is
necessary to disposed of. Hence following order :
ORDER
01. The suit stands disposed of as withdrawn unconditionally.
02. Court fees be refunded to the plaintiff as per rules.
