ORDER
1. This is a Chamber Summons taken out by plaintiff for
production of Technical Advisory Committee Report (T.A.C. Report)
dated 04.10.2018. Heard Ld. Advocate Ms. Vaibhavi Pawar for the
plaintiff.
2. Perused reply submitted by defendant no.2. Perused reply
endorsed on overleaf of Chamber Summons by defendant no. 1/MCGM.
Ld. Advocate Mr. Khanvilkar for the defendant no.2 submits that it is
time bound Notice of Motion as expedited by Hon'ble Bombay High

Court. He prayed for heavy cost.
3. It is matter of record that copy of the Committee Report is
already there on record produced by defendant no.1/MCGM. It is not
disputed that both parties in proceeding are intending to rely and reply
on Committee Report. Its copy is already on record. The production of
the Committee Report by the plaintiff is mere formality. It will not cause
prejudice to any party. Hence Chamber Summons deserves to be
allowed. Hence the order :
ORDER
1. Chamber Summons No. 2136 of 2019 is allowed.
2. Plaintiff is allowed to produce TAC Committee Report
dated 04.10.2018.
3. Chamber Summons No. 2136 of 2019 is disposed off
accordingly.
4. Parties to concentrate on hearing of Notice of Motion
No.4428 of 2019 as it is time bound as per order of the
Hon'ble Bombay High Court.
