Perused chamber summons. Heard advocate for plaintiff. On 08.08.2024 last chance was granted to defendant to file reply on chamber summons. Defendant not filed reply on chamber summons till this date. Hence, proceed to decide chamber summons on merit after hearing argument of plaintiff.
Order turning down Chamber summons 295/2021 is set aside by Hon'ble Bombay High Court in Writ Petition No.7805/2021 on 25.01.2023. By virtue of that order plaintiff was supposed to carry out amendment in the plaint. However, before that plaintiff tendered Chamber Summons 450/2023 for substitution of authorized representative. That Chamber Summons was allowed on 22.08.2023. Plaintiff sought time to carry out amendment as per Chamber Summons 295/2021. However, Junior Advocate moved Exh.16 wherein instead of 24.02.2023 date is mentioned as 23.02.2023. In fact on 24.02.2023 extension of time to carry out amendment was granted. Exh.16 was allowed on 19.10.2023 and direction was given to carry out amendment. Becuase of said incorrect date i.e 23.02.2023 written in Exh.16 Registry not allowed plaintiff to carry out amendment.
This are the circumstances, due to which amendment as per Chamber Summons 295/2021 could not be carried out though there is an order of Hon'ble Bombay High Court in Writ Petition No.7805/2021. Hence, considering facts and circumstances of this suit, I find it fit to allow plaintiff to carry out amendment as per Chamber Summons No.295/2021. Its because of inadvertent mistake of Junior Advocate date was incorrectly mentioned in Exh.16 and that is the reason amendment could not be carried out. Hence, Chamber Summons is allowed. Plaintiff is permited to carry out amendment as per order of Hon'ble Bombay High Court in WP 7805/2021 in view of Chamber Summons 295/2021 within a period of two weeks, irrespective of date of this suit. Amendment shall be carried out within time and plaintiff shall submit copy of amended plaint.
