Perused plaint, documents annexed thereto and heard learned advocate for Plaintiff.  The Defendant / MCGM\''s counsel has not appeared despite service.  The Plaintiff has filed reply to the notice u/s 354 A of MMC Act and claims that no order is passed after considering the said reply.  The Defendant / MCGM, being a local authority, is under statutory obligation to pass order after considering reply of the Plaintiff before taking any coercive action.  Hence, ad interim relief in terms of prayer clause (a) is granted till passing of the speaking order after considering reply of the Plaintiff to the notice dated 14/06/2018.  If such order will be adverse to Plaintiff\''s interest then the same shall not be enforced for one week from date of service of the order to the Plaintiff.
There exists an element of settlement between the parties, hence matter is referred to mediation.
