defendant. He has submitted that the administrator
appointed of the plaintiff society has consented and
instructed for continuing of the suit and ch/s. Order
below CH/S No. 2125/19 Perused the chamber
summons which is supported by an affidavit. Also
perused the reply. The plaintiff is the domino litus
of the suit. It is submitted that the plaintiff no. 2 to
4 are neither necessary nor proper party to the suit
and therefore considering the settled law that the
society is entitled to file a suit in its own name and
it is not necessary to join office bearer or its
members, the proposed amendment can be allowed
considering the scope of Order 1 Rule 10 of the
CPC. Even otherwise the said amendment is not
going to change the nature of the suit. Hence, I pass
the following order ORDER Chamber Summons
No. 2125/19 is allowed and made absolute in terms
of prayer clause (a). Plaintiff to carry out the
amendment within two weeks and shall supply the
copy of amended plaint upon the defendants within
two weeks thereafter. Chamber summons is
disposed of accordingly.
