ORDER
1. Defendant filed instant motion for setting aside ‘no cross’
order dated 19/09/2019. It is contended by the defendant that his
advocate on 19/09/2019 was not keeping well and he was hospitalized
for one month. Therefore he could not remain present.
2. The motion is formally opposed by the other side.
3. Looking to the reasons assigned, in my view, order dated
19/09/2019 needs to be recalled in the interest of justice as the
defendant is ready to crossexamine the witness. The inconveniency
caused to the witness can be compensated by awarding cost of
Rs.2,000/ to be payable by the defendant to the plaintiff witness.
Hence, I proceed to pass the following order :

ORDER
1. Notice of Motion No. 4401/2019 is allowed subject to
payment of cost of Rs.2,000/ to the plaintiff witness.

3. Notice of Motion No. 4401/2019 is disposed off
accordingly.
