Perused the chamber summons which is supported by an affidavit of Yogesh Upadhay Director of plaintiff no.1. It is submitted that plaintiff no.2 Nandkishor Mehta is expired on 15.02.2017. The copy of death certificate is annexed to chamber summons as per Exh.A. The prayer is for deletion of name of deceased plaintiff no.2 from the cause title of the plaint. As plaintiff no.2 is dead, therefore chamber summons needs to be allowed in terms of prayer clause. Hence, I pass the following order-
                                          ORDER
Chamber Summons No.2105/19 is allowed and made absolute in terms of prayer clause (a) to (c). Plaintiff no.1 to carry out the amendment within two weeks and shall supply the copy of amended plaint upon the defendant within two weeks thereafter.
Chamber summons is disposed of accordingly.
