Advocates of both the parties are admitted that prior to passing speaking order the designated officer of the BMC has not considered reply as well as documents produced on behalf of the plaintiff. The advocate for the defendant and officer Mr. Subhodh Bamburde are submitted that the defendant corporation is ready to consider the reply, written arguments if any and documents produced on behalf of plaintiff while passing fresh speaking order. Till then the defendant corporation will not take any coercive action against the plaintiffs in respect of the suit premises. The advocate for plaintiff is also agree to the submission to the advocate of the defendants. Hence in such circumstances I pass the following order
The suit of the plaintiff is hereby disposed off with direction that the defendant corporation shall not take any coercive action against the plaintiffs in respect of the suit premises till one week after passing the fresh speaking order. The plaintiff shall option to file documents, reply, written arguments within two weeks from today. Hence, suit and draft N/M are hereby disposed off. NM be registered for statistical purpose.
