motion subject to heavy cost. Ld. counsel for plaintiff submitted
that clients has not in a position to bear the costs.
Considering the submissions made before the court, the NM no.
4317/19 is hereby allowed and made absolute subject to cost of
Rs. 2,000/- as a condition precedent to be paid to the defendants/
deposited in court within four weeks or before next date.
The NM no. 247/18 in Suit no. 3197/08 is hereby restored by
condoning the delay in the interest of justice.
NM is disposed of accordingly.
