Heard advocate for applicant. Matter is already proceeded without
reply of respondents. Applicant wants to transfer L.C. Suit
No.2627/19 from Cr No.11 to Cr No.34 for limited purpose i.e.
deciding N/M No.3831/19. The roznama dt. 06.11.2019 produced by
applicant indicates that earlier presiding officer Shri. A. N. Mare who
was then presiding officer of CR No.11 had heard the said N/M and
kept for order on it. Now the Ld. Judge Shri. A. N. Mare is presiding
over CR No.34. Since he had heard the said N/M and also kept it for
order, I am the opinion that he can be directed decide the same.
Further now the said presiding officer he is not having assignment of
MCGM and therefore after disposal of said N/M the matter can be
again transferred to CR No.11. Hence I pass following order,
ORDER
1. The L.C. Suit No.2627/19 pending in CR No.11 is hereby
transferred to CR No.34 for limited purpose i.e. for passing order on
N/M No.3831/19.
2. It is made clear that after disposal of said N/M the presiding officer
of CR No.34 shall forthwith transfer the said suit back to CR No.11.
3. Parties are directed remain present before CR No.34 on
29.01.2020.
4. As such transfer application No.265/19 is allowed.
