ORDER
This is a chamber summons taken out by plaintiff to
incorporate the speaking order issued by the designated officer of
MCGM dated 13/01/2017.
2. Heard ld. Advocate S.K.Dubey for plaintiff at sufficient
length.
3. It is strongly resisted by advocate Mhatre for MCGM,
submitted that speaking order was duly served on son of plaintiff
namely Rahul Bind, therefore, there is a huge delay in amendment
sought by plaintiff.

4. Ld. Advocate S.K.Dubey submits that there is an affidavit of
Mr. Rahul Bind vide Exh.7, wherein, it is mentioned that copy was not
received by him.
5. On perusal of roznama dated 17/12/2019, plaintiff Mr.
Devman Bind admitted the signature of his son on receipt of notice
dated 04/01/2017. Prima facie it appear delay in amendment sought
by plaintiff. However, speaking order is in continuation of impugned
notice issued by MCGM dated 04/01/2017. Hence chamber summons
deserves to be allowed. Hence the order :
- ORDER -
1. Chamber Summons No. 2058/2019 is allowed, subject to
cost of Rs.1,000/- (Rupees One Thousand Only) be
deposited to MCGM within a week.
2. Plaintiff to carry out the amendment within two weeks
from the date of uploading the order.
3. Ch/s No. 2058/19 is disposed off accordingly.
