Adv. Mulani. Exh. 8 - Affidavit of defendant about service
of C/S No. 2041/19. Ld. Adv. Hatode for plaintiff submits
that there is no merit in C/S No. 2041/19. There are no
sufficient grounds, it is prayed to dismiss the C/S. In the
alternative it is prayed for heavy cost. Ld. Adv. Mulani for
defendant requested to note there is no intentional delay. It
is prayed for fault of lawyer defendant shall not suffer.
Perused C/S and grounds mentioned in affidavit support.
No doubt there appears to be negligence on the part of
defendant to take follow up, However, it would be
appropriate to decide the suit on merit. Hence, C/S No.
2041/19 is allowed, Subject to cost of Rs. 1,500/- be paid to
plaintiff within two weeks. Copy of WS is served on
plaintiff. C/S No. 2041/19 is disposed off. Exh. 9- Written
Statement submitted by defendant. Both side to submit list
of witness and schedule of case hearing, positively on next
date. Matter is adjd.to 02-02-2021 for Issues and CM
Hearing.
