Heard the Ld adv on behalf of plaintiff.
By Notice of Motion 4223/19, the plaintiff requested to grant permission to file additional evidence affidavit @ certain documents. The matter has proceeded without written statement of the defendant. The defendant is absent and failed to file reply to the NM. The reason given by the plaintiff for failure to file the documents earlier is that the same were old and not traceable. Considering the circumstances and the explanation given by the plaintiff on affidavit and the failure of the defendant to resist the Notice of Motion, it is just and proper to allow the notice of motion and allow the plaintiff to file the additional evidence affidavit @ documents.
