ORAL ORDER
1. This Chamber Summons is taken out by the plaintiff for
taking on record the legal heirs deceased defendant No.3.
2. Perused the Chamber Summons. Heard advocates for the
parties at the length.
3. It is contended by the plaintiff that during the pendency of
the suit, defendant no.3 has expired. Defendant No.3 survived by wife,
son and married daughter. Therefore, it is necessary to cause
amendment in the plaint by taking names of respondent nos.1 to 3 who
are legal heirs of deceased defendant No.3 on record of this suit.
4. If the nature of the amendment is seen, it is pertaining to
taking legal heirs of deceased defendant no.3 on record of this suit. The
plaintiff has filed this chamber summons for the same within limitation.
The proposed amendment will not change the nature of the suit in any
way. Hence, the proposed amendment deserves to be allowed for
causing amendment in the plaint. Hence, I pass following order.
ORDER
1. The Chamber Summons No.2032/2019 is allowed.
2. The plaintiff to carry out amendment in the plaint within
14 days from today
3. The Chamber Summons No.2032/2019 is disposed off.
