ORDER
This is a motion submitted by defendant MCGM to set aside
order dated 17/06/2019 and prayed for permission to lead evidence.
2. Perused reply submitted by plaintiff, it is strongly objected.
3. Heard ld. advocate Chavan for MCGM, submits that
concerned officer was transferred from 'S' Ward to another ward and
there was no proper communication to lead evidence in this case.
Plaintiff in person submits that his lawyer is out of station.

4. On perusal of roznama, matter is 8 years old. On
numerous occasion adjournment was granted to both side. Plaintiff has
filed evidence in 2016. It would be appropriate to decide the suit on
merit. It is assured on behalf of MCGM to lead the evidence positively
on next date.
5. Considering aforesaid discussion, following order is
passed :
ORDER
1. Notice of Motion No. 4198/2019 is allowed, no order of
cost.
2. No evidence order dated 17/06/2019 is set aside.
3. MCGM to submit evidence positively on next date.
4. N/m No. 4198/19 is disposed off accordingly.
