Perused the application and heard both the sides. By this application plaintiff is asking for return of original documents i.e. Exh. 24 to Exh. 28 as he wants it for  his some personal use. On behalf of defendant application is not opposed. I have gone through the documents Exh. 24 to Exh. 28 i.e. Original Bank Passbook of plaintiff\''s account, Original L.I.C Policy in the name of plaintiff\''s son, Original Passports of plaintiff\''s son Jitendra and Yatish, Original Ration Card in the name of plaintiff. These documents required by the plaintiff for his personal work means updation of Bank passbook, incorporation of the name of his doughtier in law and grand daughter in the Ration Card and passports for obtaining the Visa. Thus taking into consideration need of plaintiff of the original documents Exh. 24 to Exh. 28 and no objection of other side. I think fit that by keeping the verified true copies on record if the original documents are returned to plaintiff, the very purpose would be served. In the result accordingly following order is passed.

1. The present Chamber Summons was taken out by the applicants for bringing on record legal representatives of deceased sole plaintiff on record. It is the contention of applicants that they are the legal representatives of deceased sole plaintiff who died on 22/09/2025 living behind him applicants. The applicants are the only legal heirs of deceased plaintiff. Due to demise of sole plaintiff the right to suit survives and the applicants are entitled to proceed with the suit against the defendant. It is further the contention of applicants that the Chamber summons was taken within period of limitation and therefore, prayed to allow the chamber summons and thereby to bring legal representatives of deceased sole plaintiff on record.
2. Ld. advocate for defendant strongly opposed the chamber sumons by filing the reply overleaf the Chamber summons.
3. Heard both sides. Perused record.
4. Sole plaintiff has filed the present suit against the defendants for declaration and other reliefs. During the pendancy of present suit plaintiff died on 22/09/2025. The photocopy of death certificate is filed alongwith the chamber summons, shows that plaintiff died on 22/09/2025. The present Chamber sumons was taken out on 07/11/2025. Thus, the chamber summons was taken out within limitation. The right to sue survives for the legal representatives of deceased sole plaintiff against the defendant as the property devolves upon them after the demise of sole plaintiff. Therefore, as the chamber summons is within limitation and the right to sue survives and therefore, I am of the considered opinion that to decide the matter on merit Chamber summons needs to be allowed. Hence, I pass the following order:
ORDER
1. Chamber sumons no. 3138 of 2025 is hereby allowed.
2. Legal representatives of deceased plaintiff be brought on record on or before next date.
3. Plaintiff is directed to supply the amended copy of plaint on record on or before next date.
4. In the facts and circumstances of the case no orders as to costs.
5.Chamber summons no. 3138 of 2025 is disposed off accordingly.
